TERMS AND CONDITIONS FOR FLIGHTS OPERATED TO AND/OR FROM THE PRIVATE BURNING MAN / BLACK ROCK CITY AIRPORT 88NV

DEFINITIONS
Charterer - The individual or entity requesting the chartered air service
Charter Company - The Company furnishing the air service known as Advantage Flight Solutions, LLC (“AFS”)
BRC Air Shuttle – Grouped charter flights shared by one or more Charterers between various airports and Black Rock City
Baggage – Articles, effects and other personal property, whether checked in the cargo compartment or carried in the passenger compartment.

GENERAL
Booking of flights electronically constitutes acceptance of all the terms and conditions listed herein and constitutes a legal and binding contract between the Charterer and Charter Company.

PRICES, PAYMENTS, CANCELLATION, AND NO-SHOWS
All prices quoted herein are accurate on the date quoted, are subject to change without notice, and are valid for two business days from the date listed on the quote. For electronic bookings, full payment is due by credit card at the time of booking unless otherwise arranged in advance; for all other bookings, full payment is due within two business days of quote issuance. Final amounts may vary from this quotation. BRC Air Shuttle charges and fees shown are based on a minimum of three passengers per flight. All flights to and/or from Black Rock City are non-refundable once booked and paid for. Passengers who cancel their bookings and/or do not show up for their flight will not receive a refund. In the event of flight cancellations due to weather, Charter Company may at its sole discretion endeavor to arrange alternate flights at the soonest safe and feasible opportunity for passengers who have presented themselves for check-in. In the event that alternate flights are unable to be arranged, passengers who have checked in for their flight and who have not been accommodated on an alternate flight will receive a credit in the amount paid that may be applied exclusively to flight(s) to/from Black Rock City in the following year. All flights to/from the private Black Rock City Airport are controlled by Black Rock City LLC and operate at their sole discretion.

AUTHORIZATION TO CHARGE
By making online bookings and/or submitting credit card information for payment, Charterer authorizes Charter Company to process the full amount of the above referenced charter to the credit card provided. Charterer understands and agrees to abide by all terms and conditions listed here and as set forth by the credit card company.

BAGGAGE AND WEIGHT RESTRICTIONS
All passengers and baggage will be weighed prior to any flight. Charter Company will not accept baggage whose size, weight, or character makes it unsuitable for transportation on the aircraft as determined by Charter Company and/or the pilot in command of the aircraft. If the combined weight of all passengers and their baggage exceeds the aircraft weight limit, the aircraft cannot depart. Charter Company reserves the right, without refund, to remove a passenger or their baggage from any flight due to non-compliance with the baggage and weight restrictions. All baggage is subject to inspection.

RESTRICTIONS ON BRC AIR SHUTTLE FLIGHTS TO/FROM BLACK ROCK CITY
Each passenger is allowed one carry-on bag up to 25 pounds (11.3 kg) at no additional charge. Baggage cannot exceed the size of a commercial airline carry-on (24 inches (56 cm) in length, 14 inches (36 cm) in width, and 9 inches (23 cm) in height; soft sided and/or duffel bags preferred. Subject to load, one additional carry-on-size bag not exceeding 30 pounds (13.6 kg) may be arranged in advance. Subject to operational constraints, additional baggage/cargo may be arranged in advance by calling +1 775 852-3512.

PROHIBITED ARTICLES
Hazardous materials will not be accepted for transport. No firearms, ammunition, explosives, or fireworks may be transported to or from Black Rock City. Live animals are not permitted to be transported to Black Rock City.

REQUIRED IDENTIFICATION AND TICKET DOCUMENTATION
Each passenger is required to produce valid government-issued photo identification prior to flight. For all flights departing to Black Rock City, Burning Man tickets or will-call confirmation numbers are required to be presented on check-in. Passengers without event tickets or will-call confirmation numbers will not be permitted to board the aircraft. For all flights departing to Black Rock City prior to the official event opening time, bar-coded Early Arrival Passes must be presented before being permitted to board the aircraft. Black Rock City LLC requires all air carriers to electronically transmit all passenger name, flight, and event ticket information prior to flight departure. Event tickets, official identification, and where applicable, event Early Arrival Passes are the responsibility of each passenger. Passengers arriving at the event without valid tickets or will-call confirmation numbers, and, if applicable, valid Early Arrival Passes are required to be transported away from Black Rock City Airport and the event location by Charter Company.

BLACK ROCK CITY AIRPORT GATE FEES
Black Rock City LLC charges $60.00 per person for all Airport arrivals at Black Rock City. These fees are the sole responsibility of each passenger.

AIRCRAFT TYPES
Except for BRC Air Shuttle flights, charter quotes are aircraft type-specific and are based upon aircraft and crew availability; a change in aircraft type may vary costs. Charter quotes are valid for 48 hours from issuance. For BRC Air Shuttle flights, aircraft types may be substituted without notice with any aircraft authorized for operation to/from Black Rock City.

RESPONSIBILITY FOR OPERATIONS
Charter Company will endeavor to carry Charterer and any passengers included in Charterer’s booking with reasonable dispatch, but any departure or arrival times shown are not guaranteed and form no part of this contract. Charterer may, without notice, substitute alternate air carriers or aircraft. Indicated departure and arrival times are subject to change without notice. Charterer is not responsible for or liable for failure to make connections to other transportation, or to operate any flight according to indicated departure or arrival times, or for a change to the operating times of any flight. Under no circumstances shall Charterer be liable for any special, incidental or consequential damages arising from the foregoing.

ITINERARY CHANGES and TRANSMITTAL OF CHANGES
Itinerary changes are permitted but are subject to aircraft and crew availability and are subject to price adjustment. BRC Air Shuttle change fees are $100 per person until August 1, then $200 per person through the end of the event. Notification of change requests and/or cancellations must be in writing and emailed to info@advantageflight.com no later than seven days prior to confirmed departure.

RESPONSIBILITY
Charter Company shall not be liable for any injury, damage, loss, expense, misconnection, indirect, special or consequential damages, or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any company or person engaged in conveying the passenger or carrying out the arrangements for Charterer’s trip, or by accident, delay, flight schedule change, cancellation, sickness, weather, strikes, war, quarantine, or any similar cause. Charter Company liability shall in any case be limited to the amount paid by Charterer.

PARTIAL COMPLETION OF FLIGHTS
Charter Company is not liable for expenses incurred for replacement transportation in the case of mechanical disruption or delay. If a flight does not reach its destination due to weather, charges apply to any destination reached and return flight of the aircraft and crew (with or without passengers) to home base. In the case of mechanical disruption, Charter Company may at its sole option provide substitute transportation which may be charged as an additional fee to charterer. In such cases Charter Company's original charges apply only on portions of flight completed.

OPERATIONAL
Aircraft owned or leased by Charter Company are operated under FAA Part 135 Air Carrier Certificate #V2FA328L. Charter Company may arrange contracted aircraft that are operated under their respective FAA Part 135 Air Carrier Certificates, in which case Charterer shall hold harmless and shall indemnify Charter Company against any and all losses.

GOVERNING LAW
Any claim shall be adjudicated in and governed by the laws of Nevada.
